Terms of Use — Boom Pop Boop

Boom Pop Boop is made by Lewis Logic LLC (Colorado, USA). By downloading or using the app you agree to these terms. If you are letting a child use the app, you are agreeing on their behalf, and you remain responsible for how they use it.

The app is free

Boom Pop Boop costs nothing, contains no advertising, and sells nothing. There are no accounts, no subscriptions, and no in-app purchases. Nothing in the app asks anyone for money, and no part of it can be unlocked by paying.

What you may do

Use the app on the devices you own or control, for personal, non-commercial purposes, for as long as you like. That permission is a licence, not a sale — Lewis Logic LLC keeps ownership of the app itself, along with its artwork, sounds, characters, name, and logo.

What you may not do

  • Copy, sell, rent, sub-licence, or redistribute the app.

  • Reverse-engineer, decompile, or disassemble it, except where the law specifically says you may.

  • Remove or obscure any notice of ownership.

  • Use the artwork, sounds, or name in your own product or advertising.

Supervision and safety

The app is built for very young children, and it is built to be safe: there is no way to reach the internet, contact anyone, or spend money from inside it.

It is not a substitute for supervision. The Android screen-pinning feature and iOS Guided Access make it harder for a child to leave the app, but neither one prevents every accidental exit and neither is a childminder. A parent or guardian should decide when, where, and how long a child uses the app, including how loud it is and how close the screen is.

About the learning

The app shows letters, numbers, shapes, colours, and animals, and says their names aloud. It is a toy that teaches, not a curriculum or an assessment. We make no promise about educational results, developmental outcomes, or readiness for school, and the app is not a diagnostic tool of any kind.

Pronunciation comes from your device's own text-to-speech software, so accent and clarity depend on the device and the language settings you have chosen — not on us.

No warranty

The app is provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement. We do not promise the app will be uninterrupted, error-free, or compatible with every device, and we may change or discontinue it at any time.

Some jurisdictions do not allow the exclusion of implied warranties, so parts of this section may not apply to you.

Limitation of liability

To the fullest extent the law allows, Lewis Logic LLC is not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, arising out of your use of the app. Where liability cannot be excluded, it is limited to the amount you paid for the app — which is nothing.

Some jurisdictions do not allow these limitations, so parts of this section may not apply to you.

Privacy

The app collects no personal information at all. See the Privacy Policy for the detail.

Apple

If you obtained the app from the App Store, you should know that:

  • This agreement is between you and Lewis Logic LLC only, not with Apple. Apple is not responsible for the app or its content.

  • Apple has no obligation to provide any maintenance or support for the app.

  • If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price — which, this app being free, is nothing. Apple has no other warranty obligation whatsoever.

  • Apple is not responsible for addressing any claim by you or a third party relating to the app, including product liability claims, any claim that the app fails to conform to a legal or regulatory requirement, and claims arising under consumer protection or similar legislation.

  • Apple is not responsible for investigating, defending, settling, or discharging any third-party claim that the app infringes intellectual property rights.

  • Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

Google Play

If you obtained the app from Google Play, your use is also subject to the Google Play Terms of Service. Google is not a party to this agreement and is not responsible for the app.

Changes

These terms may change when the app changes. The effective date above will move when they do, and continuing to use the app after that means accepting the new version.

Governing law

These terms are governed by the laws of the State of Colorado, USA, without regard to its conflict-of-laws rules.
