Terms of Use for ChessKata

These Terms of Use ("Terms") govern your use of the ChessKata app. By downloading or using ChessKata, you agree to these Terms. If you do not agree, please do not use the app.
1. Who we are
ChessKata (the "app") is provided by Lewis Logic LLC ("we", "us"). You can reach us using the details in the Contact section below.
2. License to use the app
We grant you a personal, non-exclusive, non-transferable, revocable license to download and use ChessKata on devices you own or control, for your personal, non-commercial use, subject to these Terms and the rules of the app store you downloaded it from.
Using the app to study with your own students — as a coach, teacher or parent — is personal use and is expressly permitted, including the multiple-profile feature provided for that purpose. Redistributing the app itself, or offering it as a service to others, is not.
3. Things you agree not to do
Copy, modify, distribute, sell, or lease any part of the app.
Reverse engineer, decompile, or attempt to extract the source code, except to the extent this restriction is prohibited by law.
Use the app in any unlawful way or to interfere with its normal operation.
Use the app's import features in a way that breaches the terms of Chess.com or Lichess, or that places unreasonable load on their public APIs.
4. Purchases
ChessKata offers a one-time in-app purchase that removes the free plan's limits. All purchases are processed by the app store you downloaded the app from — the Apple App Store or Google Play — and are subject to that store's terms. We do not process or store your payment details.
The unlock is a one-time, non-consumable purchase. It is not a subscription and does not recur.
The free plan allows 100 stored flashcards, 25 annotated games and 1 profile. The unlock removes all three limits.
Reaching a limit never deletes, hides or locks anything you have already written. Reviewing, editing and exporting your existing work continue to function on the free plan.
You can restore a previous purchase on a new or reinstalled device using the "Restore purchase" option in Settings or on the plans screen.
Promotional codes issued through the App Store or Google Play are redeemed through that store's own redemption screen.
Refunds are handled by Apple or Google under their respective policies, not by us.
Prices are set and displayed by your app store, may vary by region, and may change over time. Features included in the unlock may evolve as the app is updated.
5. Your content and data
ChessKata stores your imported games, flashcards, notes, annotations and review history locally on your device. You keep ownership of everything you write.
We have no server, no copy of your content, and no ability to recover it. If you delete the app, or lose the device, your content is gone. Export anything you would be sorry to lose.
Our handling of data is described in our Privacy Policy, which is incorporated into these Terms by reference.
6. Third-party content and services
ChessKata can import games you have played on Chess.com and Lichess using those services' public APIs. Those games are your own records of your own play; we make no claim to them and provide no warranty about the accuracy or availability of either service. Your use of those services is governed by their own terms.
The app includes a bundled open-source chess engine and other open-source components. Their licenses are listed in the app under Settings → Licenses.
7. Intellectual property
The app, including its name, design, graphics, and code, is owned by Lewis Logic LLC and is protected by intellectual-property laws. These Terms do not transfer any ownership rights to you.
8. Availability and changes
We may update, change, or discontinue the app or any of its features at any time. We aim to keep the app working well but do not guarantee it will always be available, uninterrupted, or error-free.
9. Disclaimer of warranties
The app is provided "as is" and "as available", without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement, to the fullest extent permitted by law.
Chess analysis produced by the bundled engine is a computed suggestion at a limited search depth, not authoritative instruction. Nothing in the app is a guarantee of improvement at chess.
10. Limitation of liability
To the fullest extent permitted by law, Lewis Logic LLC will not be liable for any indirect, incidental, or consequential damages arising from your use of, or inability to use, the app — including any loss of the games, notes or flashcards stored on your device. Our total liability for any claim relating to the app will not exceed the amount you paid us for it.
11. App store terms
Your use of ChessKata is also subject to the terms of the app store you downloaded it from. If you obtained the app from the Apple App Store, Apple is not a party to these Terms and is not responsible for the app; the Apple standard Licensed Application End User License Agreement also applies, and in case of conflict its purchase-related terms prevail for App Store purchases.
12. Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Continued use of the app after a change means you accept the updated Terms.
13. Governing law
These Terms are governed by the laws of the State of Colorado, without regard to its conflict-of-law rules, except where local consumer-protection law grants you additional rights.
